Refresco alleges that it invested heavily in setting up and dedicating a production line exclusively for Prime Hydration products based on promises made by the defendants. This included costs for re-equipping and maintaining the production line, as well as forgoing potential opportunities with other customers. Refresco claims that the defendants failed to purchase the "guaranteed annual minimum volume" of products as agreed, leading to substantial financial losses.

Additionally, Refresco argues that if the contract was terminated early, it was due to the "defendants' concealed intention to cease performing" and their claim that the agreement had "terminated under its own terms" without informing Refresco. As a result, Refresco is seeking damages, including a minimum of $67,710,000, to compensate for the financial harm caused by official UFC drink Prime Hydration’s actions and inactions.
